Terms of Service
Last updated: August 2026
1. Agreement to these terms
These Terms of Service ("Terms") are a binding agreement between you and Dispatch Harbor, a division of Adserve Pros ("we", "us", "our"), the operator of I Need an HVAC Tech at needanhvactech.com (the "Site"). By using the Site, tapping a call button, or calling a number displayed on the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
2. What we are — and what we are not
I Need an HVAC Tech is an independent marketing and referral service operated by Dispatch Harbor, a division of Adserve Pros. We are not an HVAC company, and we do not employ HVAC technicians. We do not perform heating, ventilation, air conditioning or any other home-services work. We do not employ, supervise, license, bond, insure, guarantee, endorse or control the independent third-party providers who may receive your call.
Any agreement for services, pricing, scheduling, warranty, workmanship or payment is solely between you and the provider you choose. You are responsible for verifying a provider's licensing, insurance, qualifications, reviews and pricing before hiring them.
3. Calls and how connections work
Numbers displayed on the Site may be routed dynamically. When you call, your call may be connected with one or more independent third-party providers, or with a call center acting on their behalf. Connection is not guaranteed, and availability, response times and service areas vary. Calls may be recorded or monitored for quality, training and compliance purposes. Standard carrier charges may apply.
4. Eligibility and acceptable use
You must be at least 18 years old to use the Site. You agree not to:
- Submit false, misleading or fraudulent information, or impersonate anyone.
- Use the Site or the phone numbers on it for solicitation, robocalls, autodialing, scraping, spam or any unlawful purpose.
- Copy, frame, mirror, reverse engineer or resell any part of the Site, or interfere with its operation or security.
- Use automated systems to access the Site except for standard search indexing.
5. No professional advice
Content on the Site, including any information about repair versus replacement, symptoms, maintenance or costs, is general information only. It is not professional, safety, engineering or legal advice, and it should not be relied on for decisions about your equipment or home. If you suspect a gas leak, carbon monoxide, electrical hazard or fire risk, leave the property and call 911 or your utility's emergency line immediately.
6. Intellectual property
The Site, its content, layout, graphics and marks are owned by Dispatch Harbor or its licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive license to view the Site for your personal, non-commercial use. All other rights are reserved.
7. Third-party links and services
The Site may link to or rely on third-party services, including analytics, advertising and call-routing platforms. We do not control those services and are not responsible for their content, availability, or practices. Your use of them is governed by their own terms and policies.
8. Disclaimer of warranties
The Site and any referral are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Site will be uninterrupted or error-free, that any provider will be available, respond, or perform to your satisfaction, or that any information on the Site is accurate, complete or current.
9. Limitation of liability
To the fullest extent permitted by law, Dispatch Harbor and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, property damage, personal injury or goodwill, arising out of or relating to your use of the Site or any services performed by a third-party provider. Our total aggregate liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100).
10. Indemnification
You agree to indemnify and hold harmless Dispatch Harbor from any claims, damages, liabilities, losses and expenses, including reasonable attorneys' fees, arising out of your use of the Site, your violation of these Terms, or any dispute between you and a third-party provider.
11. Disputes and governing law
These Terms are governed by the laws of the state in which Dispatch Harbor is organized, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days. Any dispute that cannot be resolved informally will be resolved by binding individual arbitration, and you and we waive the right to a jury trial and to participate in a class action, except where prohibited by law. You may bring an eligible claim in small claims court instead.
12. Changes, termination and severability
We may modify these Terms at any time by posting an updated version with a new "Last updated" date. Continued use of the Site after changes take effect constitutes acceptance. We may suspend or discontinue the Site, or restrict your access, at any time. If any provision is found unenforceable, the remaining provisions stay in effect.
